Rulemaking action by the Iowa Board of Pharmacy has been published in the Iowa Administrative Bulletin as follows: 

Adopted Emergency / Notice of Intended Action

ARC 5820C has been filed by emergency action, adopted by the Board at its meeting on July 14, 2021, and amends Chapter 3, “Pharmacy Technicians.” 

  • The rule identifies the minimum requirements for pharmacy technicians to engage in vaccine administration when delegated by a supervising pharmacist. 

  • The rulemaking became effective July 15, 2021.

The “double barrel” rulemaking requires publication of the same amendments via Notice of Intended Action to solicit public comment.

ARC 5831C has been filed as a Notice of Intended Action and provides the same amendments as identified in ARC 5820C. 

  • Comments may be submitted until 4:30pm on August 31, 2021.

  • A public hearing will be held at the Board offices at 10:30am on September 2, 2021.

Notice of Intended Action

ARC 5833C has been published as a Notice of Intended Action to amend Chapter 3, “Pharmacy Technicians,” Chapter 8, “Universal Practice Standards,” Chapter 20, “Compounding Practices,” and Chapter 39, “Expanded Practice Standards.” 

  • The proposed amendments:

    • Provide for the renewal or reactivation of a technician trainee registrant who was, due to exceptional circumstances, unable to attain national pharmacy technician certification and who seeks an additional year of training or study;

    • Require pharmacy which have dispensed compounded human drug products interstate to annually report compounding data to the National Association of Boards of Pharmacy information sharing network to comply with a memorandum of understanding between the board and the federal food and drug administration; 

    • Update the rules relating to statewide protocols to move the training and education requirements out of administrative rule and into the statewide protocols directly; 

    • Move and clarify language relating to vaccine and medication administration via patient-specific prescriptions and reporting requirements in the case of serious complications; and 

    • Update language relating to pilot demonstration research projects.

  • Comments may be submitted until 4:30pm on August 31, 2021.

ARC 5834C has been published as a Notice of Intended Action to amend Chapter 6, “General Pharmacy,” Chapter 8, “Universal Practice Standards,” and Chapter 10, “Controlled Substances.” 

  • The proposed amendments:

    • Provide minimum security and monitoring system requirements;

    • Allow a pharmacist, under specific conditions, to delegate the dispensing of a prescription which otherwise requires pharmacist counseling while the pharmacist is on a break; 

    • Require pharmacies to maintain a perpetual inventory system for all controlled substances; and

    • Require an exact count or measure of all schedules of controlled substances for a controlled substance inventory count.

  • Comments may be submitted until 4:30pm on August 31, 2021.

  • A public hearing will be held at the Board offices at 1:00pm on September 2, 2021. 

ARC 5835C has been published as a Notice of Intended Action to amend Chapter 8, “Universal Practice Standards.” 

  • The proposed amendment provides for the identification of an interim pharmacist in charge in situations when the permanent pharmacist in charge is not vacating the position but is out of the pharmacy for an extended leave of absence. The notification would be on a form provided by the board and not require a pharmacy license application or result in the permanent change of the pharmacist in charge.

  • Comments may be submitted until 4:30pm on August 31, 2021.

ARC 5836C has been published as a Notice of Intended Action to amend Chapter 21, “Electronic Data and Automated Systems in Pharmacy Practice.”

  • The proposed amendments update processes relating to the submission and review of petitions for an exemption to the electronic prescription transmission mandate.

  • Comments may be submitted until 4:30pm on August 31, 2021.

  • A public hearing will be held at the board offices at 2:30pm on September 2, 2021.

ARC 5837C has been published as  Notice of Intended Action to amend Chapter 10, “Controlled Substances.”

  • The proposed amendments:

    • Temporarily identify three List I chemicals as precursor substances and

    • Add four substances (two schedule I, one schedule IV and one schedule V) into the Iowa CSA

  • Comments may be submitted until 4:30pm on August 31, 2021.
