At the January 12 & 13, 2016 meeting of the Iowa Board of Pharmacy (Board), the following disciplinary action was taken:

Ed Sarrazin, Pharmacist, entered into a Settlement Agreement and Final Order that places his pharmacist license on probation for five years with conditions. The Settlement Agreement resolves the Statement of Charges filed on March 12, 2014.

Mark Odland, Pharmacist, entered into a Settlement Agreement and Final Order to voluntary surrender his pharmacist license. The Settlement Agreement resolves the Emergency Adjudicative Order and Statement of Charges filed on January 8, 2013.

Downing Labs, LLC, f/k/a NuVision Pharmacy, Inc., nonresident pharmacy, entered into a Settlement Agreement and Final Order in which NuVision Pharmacy agreed to pay a civil penalty of $5,000. Downing Labs was issued a new nonresident pharmacy license number and cited and warned for failing to timely submit a new application for pharmacy license changes.  The Settlement Agreement resolves the Statement of Charges filed on November 4, 2015. 

Keysource Medical Inc., wholesaler, entered into a Settlement and Final Order in which it was cited and warned for violating the pharmacy drug laws or rules of another state while under the jurisdiction of that state and for failing to timely notify the Board of discipline.  Respondent also agreed to pay a civil penalty of $1,000.  The Settlement Agreement resolves the Statement of Charges filed on November 4, 2015. 

Dawn Ruehle, Pharmacist, entered into a Settlement and Final Order in which she was cited and warned for violating the duties of a pharmacist in charge and agreed to complete 1.0 CEU/10 contact hours of continuing education in the area of pharmacy laws and rules, record keeping, DEA regulations, and/or managing a pharmacy.  Respondent agreed to undergo inspections by a Board compliance officer should she become pharmacist in charge at a pharmacy.  The Settlement Agreement resolves the Statement of Charges filed on November 4, 2015. 

Hy-Vee Pharmacy 1068, pharmacy, entered into a Settlement Agreement and Final Order that places its pharmacy license on probation for three years with conditions.  Respondent also agreed to pay a civil penalty of $5,000.  The Settlement Agreement resolves the Statement of Charges filed on November 4, 2015.   

Priority Pharmaceuticals, Inc., wholesaler, entered into a Settlement Agreement and Final Order to voluntarily surrender its Iowa wholesale drug license.  The Settlement Agreement resolves the Statement of Charges filed on November 4, 2015. 

Drug Depot, Inc. d/b/a APS Pharmacy, nonresident pharmacy.  The Board filed a Notice of Hearing and Statement of Charges, charging the nonresident pharmacy with providing pharmacy services to Iowa residents without an active Iowa pharmacy license. A hearing is scheduled for March 8, 2016.

Ankeny Pharmacy, pharmacy.  The Board filed a Notice of Hearing and Statement of Charges, charging the pharmacy with improper delegation to pharmacy technicians, failure to properly verify and document, misuse of returned patient med paks, failure to maintain accurate perpetual inventory, failure to keep and maintain records, and failure to maintain annual inventory of controlled substances. A hearing is scheduled for March 8, 2016.

Rockford Anderson, Pharmacist.  The Board filed a Notice of Hearing and Statement of Charges, charging the pharmacist with improper delegation to pharmacy technicians, failure to properly verify and document, misuse of returned patient med paks, failure to maintain accurate perpetual inventory, failure to keep and maintain records, failure to maintain annual inventory of controlled substances, violating the duties of pharmacist-in-charge, and misrepresentative deeds. Respondent is the owner and Pharmacist in Charge at Ankeny Pharmacy.  A hearing is scheduled for March 8, 2016.

Kevin O’Rourke, Pharmacist. The Board issued a Findings of Fact, Conclusion of Law, Decision and Order reinstating Respondent’s pharmacist license upon the successful completion of an internship and passage of the NAPLEX and MPJE examinations.  Once reinstated, Respondent’s license will be placed on probation with conditions.  This Order resolves Respondent’s Request for Reinstatement.
